Introduction
The e-commerce website www.seliijan.com (hereinafter referred to as the "Site") is an online platform accessible via the Internet, open to all users of this medium (hereinafter referred to as "Users"). It is operated by BYJANIINE (hereinafter referred to as "BYJANIINE"), a simplified joint-stock company with a single associate, with a share capital of 1,000 Euros, having its registered office at 3 rue Jacques Offenbach, 06000 NICE, registered with the Paris Trade and Companies Register under the number [registration number]. VAT number: FR80950908418.

The Site allows BYJANIINE to offer for sale textile products and accessories under the SELIIJAN brand (hereinafter referred to as the "Products") to Users browsing the Site (hereinafter referred to as "Customers"). For the purposes of these terms and conditions, it is agreed that the Customer and BYJANIINE shall collectively be referred to as the "Parties" and individually as a "Party," and that the Customer placing an order shall be referred to as the "Buyer."

Any order for a Product offered on the Site implies the acceptance by the Buyer of the following terms and conditions of sale. BYJANIINE reserves the right to modify these terms and conditions at any time by publishing a new version on the Site. The applicable terms and conditions are those in effect at the date of purchase.

Article 1. Purpose
These terms and conditions of sale govern the rights and obligations of the Parties arising from the online sale of Products offered on the Site and apply to the exclusion of any other document.

Article 2. Products - Prices

2.1 Products
Only the Products displayed on the Site at the time of consultation by the Customer are offered for sale. The Products are limited to the European Union area. The offer of Products and prices is available, subject to availability, as long as they are presented on the Site.

2.2 Prices
Prices are indicated in Euros, including all taxes. The prices applied are those displayed on the Site at the time the order is placed. The total amount for preparation and delivery fees will be communicated to the Customer on the order summary before the validation of said document. Please note that shipments to destinations outside the European Community are subject to import taxes and customs duties (DDU Deliver Duties Unpaid) according to the regulations of your country of origin.

Article 3. Placing an Order

3.1 Order Registration
The Customer wishing to place an order selects the Product(s) of their choice by clicking "Add to Cart." At any time, the Customer can:

  • Check the number of Products in their cart and obtain detailed information about each item by clicking on "My Cart."
  • A new Customer must fill in all the necessary information fields to create their customer account. The Customer must accurately complete the form provided, which will contain the necessary information to identify them, including their email address and a password provided by Shopify via SMS or email (which will be personal and confidential) to allow them to connect to the Site. Any existing customer with a password must log in after clicking "Confirm" by entering their email address and password. The Customer agrees that this method of identification may prove their identity. They are required to provide personal information to engage in distance selling. This information is necessary for processing and delivering orders as well as for billing. After placing the order and once all required information is filled in by the Customer, they will have acknowledged the terms and conditions of sale to which they have agreed by checking the designated box.

3.2 Order Validation
The validation of the cart confirmation constitutes an electronic signature. This signature serves as a handwritten signature and constitutes proof of the integrity of the order and the amount due for said order. Once the order is validated, the Customer becomes the Buyer. Notwithstanding the application of Article R624-3 of the Penal Code, the Customer pays for their order by credit card (Carte Bleue, Visa, Eurocard/Mastercard). If the Customer wishes to make a payment by credit card, they must provide the card number. The type of card, expiration date, and CVV code must also be provided.

3.3 Payment
The amount owed by the Buyer is the total amount indicated on the order summary. In all cases, the amount debited corresponds to the Product(s) to be delivered. When selecting a credit card as the payment method, the Buyer will be automatically redirected to the secure payment server of STRIPE. Payment for purchases is made exclusively by credit card (Carte Bleue, Visa, Eurocard/Mastercard) at the time of ordering. The debit of the credit card will occur no later than six (6) days after the order is placed, in the currency of the order.

You can make your purchases with complete peace of mind, as the confidentiality of banking information transmitted through the site to an authorized banking institution occurs in a secure environment (SSL protocol) through our partner STRIPE.

Credit card numbers are not stored on our site but on the secure site of the banking institution STRIPE.

As part of the electronic payment process and to prevent fraudulent use of online payment methods, we verify the reliability of the information you provided when registering your order.

3.4 Acknowledgment of Receipt of the Order
Once payment is made, a summary document of the order is sent to the Buyer’s email address. This document serves as an acknowledgment of receipt and summarizes all components of the contract between the parties. A link to the return form will also be included in this document.

Article 4. Delivery
BYJANIINE will make every effort to ensure that the order is delivered within an average of 1 to 3 days from the day after the Buyer validates the order. It is specified that orders placed on the site www.seliijan.com on Fridays, Saturdays, or Sundays will be processed on the following Monday. Orders placed on the site www.seliijan.com on public holidays other than Fridays, Saturdays, and Sundays will also be processed on the following working day. The Products ordered by the Buyer will only be delivered within the borders of the EU to the address indicated by the Buyer on the order validation page, accompanied by a delivery note. The Buyer has the option to have the Products delivered to an address other than their own. Delivery is not guaranteed in cases of force majeure, transport strikes, and/or disruptions in postal services.

Parcel Reception and Claims

Upon receiving your parcel, we recommend following the steps below to ensure proper receipt and prevent any disputes:

1. Parcel Condition Check

Before signing or providing the receipt code, we advise you to inspect the exterior condition of the parcel. By signing or confirming receipt via code, you accept the parcel as it is and acknowledge that it has arrived with no visible signs of damage or tampering by a third party.

2. Reception at Pickup Point

If collecting your parcel from a pickup point, we recommend conducting these checks on-site before taking possession. If you have any doubts, you are entitled to refuse the parcel to avoid any potential disputes.

3. Proof of Receipt and Unboxing

We encourage you to **record a video of the parcel’s unboxing upon receipt**. The video should capture the parcel in its sealed state, followed by the entire unboxing process until the contents are revealed. This visual proof helps us process claims quickly and transparently.

4. Claims for Empty or Damaged Parcels

If your parcel is received empty or damaged, you have 48 hours to contact us and initiate a claim. We will request a video of the unboxing, photos of the exterior packaging from all angles, and a signed declaration (form available upon request) describing the incident.

5. Reporting to Authorities

In the case of a suspected “empty” or damaged parcel, we reserve the right to share information with relevant authorities.

6. Verified Parcel Weight at Shipment

Each parcel is weighed and recorded upon dispatch. This weight is then verified by our carrier at both the departure and destination points. If weight discrepancies are found upon delivery, an investigation will be initiated, and legal action may be pursued in cases of fraud.

Article 5. Right of Withdrawal
The Buyer has a period of fourteen (14) working days from the date of delivery to notify BYJANIINE of their wish to return the Product(s) ordered at their own expense. The Buyer has an additional fourteen (14) working days to return the merchandise. If the above conditions are met, BYJANIINE will refund the Buyer the total amount of their order (price of the Products and shipping costs) according to the original payment method upon receipt of the Products, excluding return costs, which will be borne by the Buyer.

Article 6. Legal Guarantees

6.1 Legal Guarantee of Conformity
All our Products benefit from a legal guarantee, provided that they are used normally and according to the instructions given.

  • Article L.217-4 of the Consumer Code: The seller delivers a good that conforms to the contract and is liable for any defects in conformity existing at the time of delivery.

  • Article L.217-5 of the Consumer Code: The good is considered conforming to the contract if:

    • It is suitable for the normal use of a similar product and, where applicable:
    • It corresponds to the description given by the seller and has the qualities presented to the Buyer in the form of a sample or model.
    • It possesses the qualities that a Buyer can legitimately expect based on public statements made by the seller, the producer, or their representative, particularly in advertising or labeling.
    • It presents the characteristics mutually agreed upon by the parties or is suitable for any special use sought by the Buyer, communicated to the seller and accepted by them.
  • Article L.217-7 of the Consumer Code: Any defect of conformity that appears within twenty-four months of delivery of the good is presumed to exist at the time of delivery, unless proven otherwise. For second-hand goods, this period is set at six months. The seller can overturn this presumption if it is incompatible with the nature of the good or the alleged defect of conformity.

  • Article L.217-9 of the Consumer Code: In case of a defect of conformity, the Buyer may choose between repair or replacement of the Product. However, the seller may not proceed according to the Buyer’s choice if it entails a cost that is manifestly disproportionate compared to the alternative method, considering the value of the Product or the importance of the defect. In such a case, the seller must proceed, unless impossible, by the method not chosen by the Buyer.

  • Article L.217-10 of the Consumer Code: If repair and replacement of the Product are impossible, the Buyer may either return the Product and receive a refund or keep the Product and receive a partial refund.

The same option is offered to the Buyer:

  • If the requested, proposed, or agreed solution under Article L.217-9 cannot be implemented within one month following the Buyer’s complaint.

  • Or if this solution cannot be implemented without significant inconvenience to the Buyer, given the nature of the good and the use for which it is intended. However, the sale cannot be resolved if the defect of conformity is minor.

  • Article L.217-11 of the Consumer Code: The application of the provisions of Articles L.217-9 and L.217-10 is free for the Buyer. These provisions do not hinder the granting of damages.

  • Article L.217-12 of the Consumer Code: The action resulting from the legal guarantee of conformity must be initiated within two years of delivery of the Product.

6.2 Guarantee against Hidden Defects
BYJANIINE is liable for any hidden defects in the Product(s) sold that render them unfit for their intended use or diminish their usability to the extent that the Buyer would not have purchased them, or would have paid a lower price if they had known of the defects. The Buyer has the choice between the return of the Product(s) or a reduction in the sale price.

Article 7. Information Technology and Rights

7.1 Personal Information
The personal information collected is processed by BYJANIINE for managing the customer relationship. In accordance with the French Data Protection Act, the Customer has the right to access, modify, and oppose the processing of their personal information.

Article 8. Miscellaneous Provisions

8.1 Force Majeure

These terms and conditions of sale and the order summary constitute the entire agreement between the parties.

8.3 Conservation and Archiving Operations
The archiving of invoices is carried out on a durable medium.

8.4 Governing Law and Jurisdiction
These terms and conditions of sale are governed by French law. In the event of a dispute, the consumer may seek mediation or bring the matter before the court of their choice.
